A Video: National Surrogacy Week – Top Tip #3
Obtaining a parental order – by Daniel Coombes, Director
For National Surrogacy Week we are releasing a short video each day with a top tip from one of our lawyers at FLiP who have a special interest in surrogacy. In this video, Director Daniel Coombes looks at the way an intended parent or parents become legal parents in England following surrogacy.
In England and Wales, whatever the biological position or wherever the child is born, the surrogate will always be recognised as the legal mother and, if she is married, her spouse as the father or send legal parent. This will remain the case until a parental order is made by the court, transferring legal parenthood to the intended parent or parents.
